1. About these terms
These Terms and Conditions govern your use of structuraeng.com.au (the “website”) and, where a written quote or engagement confirmation refers to them, the provision of our services. The website and services are operated by Guardian Engineering & Design Hub Pty Ltd (ABN 71 673 368 502) trading as Structura Engineering Inspections (“Structura”, “we”, “us”, “our”).
By using this website you agree to these terms. If you do not agree, please do not use the site.
2. Use of the website
You may use this website for lawful purposes only. You must not:
- use the site in a way that damages, disables or impairs it, or interferes with another user’s access;
- attempt to gain unauthorised access to any part of the site, its server or connected systems;
- use automated systems to scrape, harvest or copy content without our written permission;
- submit false, misleading or unlawful information through our forms;
- upload files containing malware or any material you do not have the right to provide.
3. Intellectual property
All content on this website — including text, graphics, photographs, logos, report templates and page design — is owned by us or used under licence, and is protected by copyright and other intellectual property laws. You may view and print content for your own personal or internal business use. You may not otherwise reproduce, republish, adapt or commercially exploit it without our written permission.
Reports we prepare remain our intellectual property. On payment in full, the client receives a licence to use the report for the purpose stated in it. The report may not be reproduced in part, edited, or used for a different purpose or by a different party without our written consent.
4. Enquiries and quotes
Submitting an enquiry or booking form does not create a contract and does not guarantee a booking. Information you provide is used to prepare a quote. Fees and turnaround times published on the website are indicative only. A binding engagement arises only when we issue a written quote or engagement confirmation and you accept it.
Quotes are valid for the period stated in them and are based on the information you supply. If the property, access or scope differs materially from what was described, we may vary the fee, and we will tell you before doing additional work wherever practicable.
5. Your obligations
To allow us to perform the services, you agree to:
- provide accurate and complete information about the property and the purpose of the engagement;
- arrange safe and lawful access to the property at the agreed time, including any keys, permissions or occupant notice required;
- disclose known hazards, including asbestos, structural instability, animals or restricted areas;
- provide any relevant plans, permits, previous reports or correspondence in your possession.
We may decline or discontinue an inspection where access is unavailable, where conditions are unsafe, or where proceeding would be inconsistent with our professional obligations. Where we attend and cannot proceed for reasons outside our control, a call-out fee may apply.
6. Scope, and what our services do not include
Our services are limited to the scope set out in the written quote or engagement confirmation and to the limitations recorded in the report itself. Inspections are visual and non-destructive unless otherwise agreed. The exclusions set out in our Disclaimer form part of these terms.
7. Independence of opinion
Our engineers owe professional duties that override any instruction from a client. Where a report is prepared for use in a tribunal or court — including VCAT — the engineer’s paramount duty is to the tribunal or court, not to the party paying the fee. We will not alter a technical finding or conclusion at a client’s request. Payment of our fee does not entitle a client to a particular outcome or opinion.
8. Fees, payment and cancellation
Fees are as stated in the accepted quote. Unless otherwise agreed in writing, reports are issued on receipt of payment in full. Payment terms, deposits, cancellation and rescheduling fees will be set out in the quote or engagement confirmation.
We may charge additional fees for work outside the agreed scope, including re-inspections, supplementary reports, extended correspondence, conferences, or attendance at a hearing or mediation.
9. Reliance by third parties
A report is prepared solely for the named client and the stated purpose. We accept no duty of care or liability to any other person who obtains or relies on the report, whether or not we were aware it might be provided to them.
10. Consumer guarantees and liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right or remedy that cannot lawfully be excluded.
Subject to that, and to the maximum extent permitted by law: we exclude all other conditions, warranties and representations; we are not liable for indirect or consequential loss, loss of profit, loss of opportunity or loss of value; and where our liability can be limited, it is limited at our option to resupplying the services or paying the cost of having them resupplied.
11. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms.
12. Complaints and disputes
If you are dissatisfied with our services, please raise it with us in writing at admin@structuraeng.com.au so we have the opportunity to address it. The parties agree to attempt in good faith to resolve any dispute by discussion before commencing proceedings, except where urgent relief is required.
13. Changes to these terms
We may amend these terms from time to time by publishing an updated version on this page. The version in force at the time you use the website or accept a quote applies to that use or engagement.
14. Governing law
These terms are governed by the laws of the State of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
